Welcome. These Terms of Service govern your use of I Got a Gig dot Com. By using our platform — whether as a musician subscriber, a fan who has opted in to show notifications, or a visitor to our website — you agree to these terms.

We've written these in plain language because we'd rather you actually read and understand them. If something is unclear, email us at help@igotagig.com and we'll explain it in plain English.
Your use of I Got a Gig is also governed by our Privacy Policy, available at igotagig.com/privacy.
I Got a Gig dot Com ("I Got a Gig," "we," "us," "our") is operated by [Owner Name / Business Entity] in New Orleans, Louisiana. We provide a text-message-based platform that helps working musicians automate their show announcements — updating websites, submitting to local music calendars (including WWOZ, OffBeat, and Gambit), and notifying fans via SMS — all from a single text message.

To subscribe as a musician, you must:
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you believe your account has been accessed without your authorization, notify us immediately at help@igotagig.com. We are not liable for losses resulting from unauthorized account access that you failed to report promptly.
We offer the following subscription tiers (current pricing always available at igotagig.com/pricing):

Prices, features, and tier names are subject to change with notice. Existing subscribers will be notified of any price changes at least 30 days in advance. Price changes will not apply to your current billing period.
Subscriptions are billed monthly or annually in advance, depending on the plan you select. Payment is processed at the start of each billing period. We use [Stripe / payment processor name] for secure payment processing. We do not store your credit card number on our servers.
Annual plans are billed as a single payment at the beginning of the annual term.
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you retain full access to the platform through the end of the period you have already paid for. We do not offer prorated refunds for partial months, except as described in Section 2.6.
To cancel, contact us at help@igotagig.com or use the cancellation option in your account settings.
If you are unsatisfied with I Got a Gig for any reason within your first 30 days as a subscriber, contact us at help@igotagig.com and we will issue a full refund of your first month's subscription fee. This guarantee applies to first-time subscribers only and does not apply to annual plan renewals or Tier 3 setup fees.

This section governs SMS messages sent from I Got a Gig to musician subscribers as part of normal platform operation.
By subscribing to I Got a Gig, you expressly consent to receive SMS messages from our system related to the operation of your account. These messages include:
These messages are necessary for the platform to function. You cannot opt out of operational messages while maintaining an active subscription.
Message frequency varies based on your activity on the platform. As a general guideline:
We will not send operational messages unrelated to your account activity.
Standard message and data rates may apply depending on your mobile carrier and plan. I Got a Gig does not charge separately for SMS messages beyond your subscription fee.
To stop receiving SMS messages from I Got a Gig, you must cancel your subscription (see Section 2.5). Replying STOP to a system message will be processed as an opt-out request; however, doing so may prevent the platform from functioning correctly for your account. If you reply STOP, contact us at help@igotagig.com so we can assist you.

This section governs the fan-facing SMS service delivered through the I Got a Gig platform. This section is specifically structured to meet Campaign Registry (TCR) requirements for A2P 10DLC SMS registration. The content of this section describes the campaign use case for TCR purposes.
Campaign Description (TCR): I Got a Gig dot Com operates an SMS-based show announcement service for musicians. Fans voluntarily opt in by texting a musician-specific keyword to a designated long code phone number. Upon opt-in, fans receive show announcements — including venue, date, time, and calendar links — whenever the musician they follow announces a show through the I Got a Gig platform. Messages are sent on behalf of individual musician subscribers. No marketing, promotional, or third-party content is included. All fans have provided express written consent via keyword opt-in. Standard opt-out (STOP), opt-in (keyword), and HELP flows are fully implemented.
Fans opt in to receive show announcements from a specific musician by texting that musician's designated keyword (for example, QUICKENING) to the I Got a Gig designated phone number. This keyword opt-in constitutes express written consent to receive SMS show announcement messages from that musician, delivered through the I Got a Gig platform.
Important: Opt-in is specific to one musician. Opting in to one musician's list does not enroll you in any other musician's list, nor does it enroll you in any marketing messages from I Got a Gig itself.
Fan phone numbers are collected solely through this keyword opt-in mechanism. Musicians are prohibited from importing or uploading phone numbers from outside this system (see Section 5.2).
Upon opting in, fans immediately receive a one-time confirmation message. Example:
"🎶 You're on [Musician Name]'s list! You'll get a text when they have a show in New Orleans. Reply STOP anytime to unsubscribe. Reply HELP for help. Msg & data rates may apply."
This confirmation is sent automatically by the I Got a Gig platform and cannot be bypassed.
Fan messages contain show announcement information only, including:
Fan messages do not contain commercial promotions, advertising for third parties, or content unrelated to the musician's upcoming performances.
Message frequency varies by musician and depends entirely on their performing schedule. Fans receive one message per show announced by the musician through I Got a Gig — there is no fixed message frequency. Based on typical musician activity on the platform, most fans can expect to receive 1–8 messages per month. Fans who follow a particularly active musician may receive more.

Standard message and data rates may apply depending on your carrier and plan. I Got a Gig does not charge fans for receiving messages.

Reply STOP to any message to immediately unsubscribe from that musician's fan list. You will receive one final confirmation:
"You've been unsubscribed from [Musician Name]'s show alerts. No more messages will be sent. Text [KEYWORD] to re-subscribe anytime."
No further messages will be sent to you from that musician after you reply STOP.
To unsubscribe from all I Got a Gig messages: Reply STOP ALL to any message, or contact us directly at help@igotagig.com.
Opt-out requests are processed immediately. STOP commands are honored universally, regardless of which keyword list you originally opted into.
Reply HELP to any fan message to receive the following response:
"I Got a Gig — show announcements for music fans. Reply STOP to unsubscribe. Questions? Email help@igotagig.com. Info: igotagig.com/terms. Msg & data rates may apply."
Fan phone numbers collected through the opt-in process are used solely to deliver show announcements from the musician the fan opted in to follow. Fan phone numbers are:

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to carrier routing and network conditions outside of I Got a Gig's control.
Our SMS service is available on all major US carriers, including AT&T, Verizon, T-Mobile, US Cellular, and regional carriers. Availability may vary by carrier.
You are responsible for the accuracy of show information you text to our system. We parse and distribute your information in good faith — we are not responsible for errors in show listings that result from inaccurate, incomplete, or ambiguous information you provided.
If a submission contains an error, contact us at help@igotagig.com and we will do our best to assist with a correction. We cannot guarantee that third-party publications (WWOZ, OffBeat, Gambit) will accept or publish corrections.
By using the fan SMS feature, you represent and warrant that:
Violations of this section are grounds for immediate account termination and may expose you to legal liability independent of your agreement with I Got a Gig.
Show information and any other content you submit through the platform must not:
We reserve the right to decline to distribute content that we determine, in our sole discretion, violates these standards.
When I Got a Gig submits show information to WWOZ, OffBeat, Gambit, or other third-party calendars on your behalf, you represent that:
We act as your agent in making these submissions. Responsibility for the content of submissions remains yours. We make no guarantee that submitted content will be published — acceptance decisions are made by the respective organizations.
You may not use I Got a Gig to:
You retain all rights to content you provide to I Got a Gig — including your bio, photos, music, show information, and any other materials. By providing content to I Got a Gig, you grant us a limited, non-exclusive, royalty-free license to use, display, reproduce, and distribute that content solely for the purpose of operating the platform on your behalf — including submitting show information to third-party calendars, sending fan SMS messages, and displaying your content on your website and any igotagig.com profile pages.
This license ends when you cancel your subscription, except to the extent we need to retain content for legal or operational purposes described in our Privacy Policy.
The I Got a Gig platform — including its software, cascade engine, design, brand, trademarks, and all related technology — is owned by [Business Entity] and is protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership rights in the platform to you. You receive a limited, non-transferable license to use the platform during your active subscription.
The fan SMS subscriber list built through I Got a Gig represents fans who have opted in to receive your show announcements. We consider that list to be yours — we will not use it for any other musician or for I Got a Gig's own marketing purposes.
However, because the opt-in mechanism is tied to our phone number and platform infrastructure, the technical delivery capability is tied to an active subscription. Upon cancellation, we will provide you with your fan list data (phone numbers and opt-in dates) in a standard exportable format (CSV) within 30 days of your cancellation request. Contact help@igotagig.com to request your export.
This section applies only to subscribers on The Signal (Tier 2) and The Headliner (Tier 3) plans.
All content on your website — including your bio, photos, music, show information, and any other materials you provide — belongs to you. Website design elements, templates, and structural components created by I Got a Gig remain the property of I Got a Gig. Upon cancellation, we will provide your content in a standard format upon request within 30 days.
For plans that include custom domain management, you are responsible for maintaining your domain registration with your domain registrar. I Got a Gig will manage the technical DNS configuration during your active subscription. If your domain registration lapses due to non-renewal on your end, we are not responsible for any resulting disruption to your website or digital presence.
Your website may include integrations with third-party services (Mailchimp, Bandcamp, Spotify, etc.). The availability and functionality of these integrations depend on the respective third-party platforms and their terms of service. We are not responsible for disruptions, changes, or discontinuation of third-party services.
I Got a Gig is provided "as is" and "as available." To the fullest extent permitted by applicable law, we make no warranties — express, implied, or statutory — regarding the platform.
Specifically, we do not warrant that:
We are a small operation building something real. We will do our best and stand behind our work — but we cannot make absolute guarantees about things that are partly outside our control.
To the fullest extent permitted by applicable law, I Got a Gig and its owner(s), employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, lost data, missed gigs, or loss of business opportunity, arising from your use of — or inability to use — the platform, even if we have been advised of the possibility of such damages.
Our total cumulative liability for any claim arising from these Terms or your use of the platform shall not exceed the total amount you paid to us in the three (3) months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless I Got a Gig and its owner(s), employees, contractors, and agents from and against any and all claims, demands, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or relating to:
Cancellation by you: You may cancel your subscription at any time per Section 2.5.
Termination by us — For Cause: We may suspend or terminate your account immediately and without advance notice if we determine, in our reasonable judgment, that you have:
Termination by us — Without Cause: We may terminate any account by providing at least 30 days' written notice by email. In the event of a without-cause termination, we will refund any prepaid subscription fees for the unused portion of your current billing period.
Effect of Termination: Upon termination of your account:
These Terms are governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law principles.
Any disputes arising from or relating to these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the state or federal courts located in Orleans Parish, Louisiana. You consent to personal jurisdiction in those courts.
Before filing any legal claim against I Got a Gig, you agree to contact us at help@igotagig.com and describe the dispute in reasonable detail. We agree to give you at least 30 days to attempt informal resolution before either party initiates formal legal proceedings. We genuinely believe most issues can be resolved directly and quickly.
We may update these Terms from time to time as the platform evolves. When we make material changes, we will:
Your continued use of the platform after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree with the updated Terms, you may cancel your subscription before the effective date.
Changes that improve your rights or reduce restrictions may take effect immediately. Changes that expand our rights or restrict yours will not be applied retroactively to your current billing period.
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and I Got a Gig dot Com regarding the platform and the services we provide. They supersede any prior agreements, understandings, or representations — written or verbal — between you and I Got a Gig.
If any provision of these Terms is found to be unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
